    Jibjab and all,

    My opinion is one has right to defend his/her stand and also right to be listended to. Also there are matching judgement for every offence, once proven guilty. And there should be a line where professional and personal liabilities separates.

    Now, If JB has done something offensive, he should be given appropriate advise and admonishment, as a normal citizen ought to be. I am sure he/she will go through that process, in course of time.

    What I am against is screwing a person twice for something that I would not subject a citizen of this country. Very fact that person's spouse is hurt, mentally and physically, should justify spouse's disgust and reaction to JB and let JB to be completely responsible for outfall of personal relationship, for his/her doing.

    What I am asking is he/her should not be subjected to dual agony of personal greivances as well as preofessional whammy... Lets justice be same for a citizen as well as Lawful Immigrant... If you have advise for him/her to save his GC, help him.

    If i want to schedule a visa interview date for my parents, do i need to enter the names for both my mom and dad and the separate receipt numbers from hdfc in the application site. i.e Do i create two separate applications? I dont have a receipt number to verify the same..Any comments are welcome and please excuse my ignorance..:D

    You and me are no experts in these matters... thats exactly why i suggested him to talk to an employment discrimination lawyer - only sure shot way to find out if something can be done, you never know...
    then again its up to him if he wants to go to this extent - if it was me i would definitely do it ;)

    I agree with you in general. But see this one is messier than just suing your company for backpay. In this case even if he wins the case he needs to work for them for the next few years, they need to co-operate with him at multiple stages! There are ample opportunities for them to screw him up again (all legally), this time wasting more of his time.

    6 months down the line with his I-140 sitting in NSC, they can always claim that because of business reasons the new job no longer exists (GC is future job) and withdraw it. They can give out ads, then actually end up finding an American that the hiring manager feels meets the requirements, so the PERM ends right there and there is nothing he can now legally do Now its 3 more months wasted, no GC and a ruined relationship with current employer.

    It might be worth talking to a lawyer, but somehow in this case I feel even if he wins, he'll lose.

    Missing birth certificate...

    we relocated recently and in that confusion... i cant seem to find my wifes BC...

    we tried to located teh records in india, and apparently no records were entered during that month in india either..so the only option is to get an BC from the court and it could take months....

    Is there an other option??? any suggestions plzzzz. :confused:

    I don't want to panic over an article like this. The media is ALWAYS on the case of immigration. However we do have all odds working against us these days. On a fair weather day, our only ally is the corporations and business who hire us. The society and media never likes the idea of immigration. In their eyes we come here to take their jobs, end of story. The government is not exactly on our side either. They make the immigration process incredibly tedious to a point that makes us wonder if it's there to facilitate immigration or to stop it. That's the old equilibrium we are used to until a year or two ago. Now with raging unemployment and our only ally seemingly becoming the "enemy of the state", it's no surprise that we are put on the chopping board.

    If I'm under the spot light for negative attentions I'd like to say "folks, let's at least put things in perspective." U.S. has a population of 300 million, of which roughly half is within the range of working ages. USCIS granted about a million greencards last year, of which only 162,176 were employment based. That is 0.1% of America�s work force, and 0.05% of the entire U.S. population. And that�s less than 6% of the number of the American people injured in car accidents in 2005. Talking about something that hurts a lot of Americans badly, let�s give automobile safety the attention it deserves, which should be 20 times that paid to employment based immigration. On the other hand, if we look at the educational background of these immigrants compared to the same age group of all American workforce I would not be surprised that the earlier surpasses the later by a large margin. That is the whole idea of employment based immigration. Accept a small group of highly educated and skilled foreigners into the society to fuel and energize its workforce and economy. Now this mere 0.05% of people, who already have to pay and struggle to stay legal thanks to the current immigration system, somehow becomes a huge crowd of seagulls and snitches that descend upon the entire country and rob jobs from everyone and kicks Americans into unemployment. Is there any justice or intelligence in that perception? Trying to fix the right problem by focusing on the wrong issues doesn�t help. Hasn�t the country learned enough lessons on this in the past 8 years? To the media, fact skewed out of proportion is a lie. Misleading the people on key national issues is unethical and unpatriotic.

    H-1B holders, who are the candidates for employment based immigration, are lawful residents. That means we are subject to all responsibilities such as taxation. We pay all taxes including those the benefits of which we aren�t even entitled to, such as social security and Medicare. We are subject to all laws and regulations as Americans and on top of that immigration law as well, which eliminates many forms of freedom enjoyed by an average citizen. To those sound advocates against immigration, who do you think you are to have the right to alienate us like we have no rights at all in this society? We aren�t robbing you, we are creating wealth for the country. We didn�t play through our earlier years, we worked hard in college and many in graduate schools as well. We aren�t sitting around collecting social benefit, we are paying for it.

    I remember watching a movie where in the old times a few African American kids witnessed a black slave being set on fire. One kid later said �I saw fear in my friends� eyes and at the same time, shame.� In some ways that�s our sentiment. We cave in when faced with unfair treatments and blames. When there is some news about a man killing his whole family after losing his job, some feel like it�s our fault. Has it occurred to anyone that his mental health was a bigger suspect for the crime than his employment status? Tough times create anger and division. In my opinion that�s the kind of ride this country has been taking until the 2008 election. This is a tough time no doubt, but it�s also the right time to restore sanity instead of injecting more biased, harmful and plainly wrong opinions into people�s mind. Immigration, although not written in the Constitution, has always been a foundation of this country. Employment based immigrants are the modern day elites of U.S. immigration. And there is nothing more American than equity and hard working. That's what we believe in and what we ask for. Immigrants are citizens by choice. That�s something to be proud of.

    For once America, try to tackle the right problem by focusing on the right issues. It�s about time!

    I think you should file your 3 year extension immediately that too in the expedited channel.
    That way you can switch over anytime.

    Mine is a similar situation.
    I got 1 year extension after I completed 6 years on H1. My I-140 was approved and my company filed and obtained 3 year extension.
    Now I have new offers and I intend to switch.
    I too have concerns about the portability of priority date, whether there would be problems during H1 transfer and so on....!

    I had the same question. According to discussion with my lawyer, the option to stay on H1 is a personal one. In any case you are using AC21 whether you get a new H1 for another co. or use your EAD. The advantage of being on H1 is you are still in status and working even if your 485 petition is turned down and you can apply to extend H1 (of course depending on your situation, labor filed or not, how much time left etc. etc.). But if you are on EAD you might yourself in a jam if your EAD renewal is turned down or delayed. You could be out of status. Also, if you want to go back to H1 from EAD you are back in the H1 queue (65k or 20k masters). You cannot transfer to H1 from a EAD job anymore without an approval thru a brand new filing.

    Are you sure about not being able to transfer H1 from EAD? If you have already finished your 6 yrs on h1B, then that is true ... but if you have some years left on H1B, then you could use those years without going through the quota.

    Hi All,

    My i-140 got RFE regarding the following:

    how do u think BS plus 5 years qualifies as EB2. My attorneys have resopnded back with Labor deptts recommendations and proof from other meetings bwetween AILA and USCIS that it is indeed EB2.

    What happens if they still do not like these explainations -
    1) Do they send Back another RFE for more proof?
    OR
    2) Reject the I-140 - in which case I file another I-140 in EB3.

    Has anyone had similar experiences?

    Can they start GC processing even before I join? I am not sure if they will agree. What if they say we will start as soon as you join


    They wont start before join. Thats for sure. Nowadays no company is doing green card as future employee.
    What if the company says ' we will file green card on day one' and they dont do it. Will you look for another job imemdiately. Think about it. Its like slow poisoning. They feed you with slow poisoning. They wont file your green card and you dont wont come out of that company since its secured. Finally you have to leave this country with tears and without green card. My experience is saying this.

    Take risks, Work as consultant, drive as slong as you can, fly as far as you can. Spend quality time with family whenever you can, file green card as soon as you can .

    While bumping the thread and being hungry for information, you might want to update all your info for IV. Then expect answers.

    You mean you want me to update Priority date, 140 and 485 dates? I filed for PERM in MAR 06 and got approved in NOV 06, Changed my Employer in MAR 07 so couldn't take adavantage of JULY fiasco. Got I-140 approval from my first PERM in NOV 07 but whats the use.

    Filed PERM from current employer in JUN/JUL 07 got audited and then denied. Case was appealed and now i have filed for withdrawal just to refile in PERM again. SO i am not at all in this green card Queue.

    Uptill last year my Information on this portal was updated. But i changed recently and marked everything as N/A because posting meaningless information doesn't make any sense. Do you need to understand that everyone is not as fortunate as you to have PERM, 140 approved and 485 pending.

    I agree. My PD (4/2003) has been current all April 2008 and I haven't seen any LUDs. On the other hand, I am seeing scores of 2007/2006 PDs being approved when their GC opportunity if years ago (Sorry guys!!).

    In line with the theory I heard last year about USCIS allowed 100s of thousands of people to apply for AOS in July/Aug 07 because it would generate a huge stream of revenue, this non-PD-based-approvals seem to validate the same. Approve I140's, keep guys on the hook for I485 and get them to keep paying for EAD/AP approvals year after year

    USCIS is illogical agency and Michael Aytes is incompetent manager.
