Good question. Not sure but could it be related to your tax filing status with IRS? Years filed under 1040-NR as a student might not count. I know students can take certain US tax exemptions due to treaties with home countries.
10 Tax years (SS/Medicare Tax Paid) and 40 Credits is very critical to get the retirement benefits after 67 1/2 years.
During the OPT Employer/Employee don't pay the SS/Medicare taxes so you wouldn't be able to include those years.
Recently there was talk between Indian Gov and US Gov regarding to swap the SS benefits, but I think it is a distant reality

May be true.Last week my EAD is approved for only one year.
My PD is Sep 2003 ( EB3)
My PD is Nov 2002 EB3. I got a 2 year EAD. So I guess the dates might jump over me and move to 2003 directly :)

As a plumber in EB3, and waiting in the uk, unable to even start my new job untill i get a green card, i feel compeled to say something.

I opened this thread to post the approvals if any of our members gets it....
There are quite a few IV members whose priority is between Jan-Jun 2004(EB2-I). Lets see if USCIS gets the job done for these guys since they are current now....

My case details are as follows:
1) EB 2 India ,priority date November 2004
2) I -140 approved in 2007(employer A)
3) Filled 485 in August 2007, changed employer after 180 days of filing I-485.
4) Got RFE in 2008 august(for EVL),responded back with all the documents from the present employer.(employer B)
Received email from CIS "RFE recieved and case process resumed "
5)Renewed EAD for my spouse.
6) Approved I-140 status changed to pending in May 2009.
7) Later renewed my EAD in June 2009 with out any problems
8) Came to know that my 140 was revoked in May 2009 by employer A
9) Received I-485 denial notice in August 2009 stating the reason"485 denied due to revoke of underlying 140 by employer A."
So now iam filing MTR with the help of attorney .
iam depressed,last year when my PD was current i missed the window ,now iam afraid again i will miss the window.
what should be my course of action apart from filling MTR,how much time it will take for my case to resume pending status .

I would suggest rather than remaining unemployed use AC21 and work for someone else since the GC is for future position and your company is willing to take care of the process and respond in case there is an RFE. When the time is right ( that is your present company has a job ) move back to your original company.
Being jobless in the current enviroment might not be a good idea. Gaps in employment are not good for several reasons but you can decide best.

But once it is denied, you can file an MTR and stay but cannot work. And in case, if the MTR is also denied then the unlawful accruation starts from the date of original denial. I have talked to several people who have been in this situation now and everybody confirms what I understand.

Now that CIR is our only hope, we have to activate ourselves and work on that. It�s rightly pointed out on another thread that we need active support from employers. Some of us might have approached our employers already with requests to call/write to local congressman or support our (or other similar) organization. This thread is to share our experiences and to brainstorm on how to broach this subject with our employers and somehow make them contribute (in some way) on this issue. For smaller companies this might be a bit easy but for employees of medium and large companies this is not that easy. I recently took an appointment with SVP of our HR (who heads HR organization of whole company of size 10K employees). I explained to him the current visa delays and how its affecting us (carefully avoiding the subject of changing employers ) and how some new rules are being proposed. I mentioned about IV and Compete America when talking about which organizations are working on this. He nodded in agreement for most of my rant. At the end I requested him to call/write local congressman to support this (I mentioned SKILL bill not CIR). His response is a standard I will discuss with COO/legal and others such. But he later indicated that it�s a politically sensitive issue which company may not want to involve. I tried to explain by giving the example of how Microsoft is trying to help in some way. He agreed to discuss further but I got the impression that they will not do anything. I tried to talk on the same subject with our company immigration attorney � he gave me a blunt �you should approach appropriate company people and not me� response.

The officers should be back from vacation. They would like to stay busy during this recession time and so will be ready to work longer :)
Dates for India moves forward only when they start giving the left overs from other countries. Seems like they do this only during the last few months of the year. So i feel significant changes may not be expected until July.

Hi All,
I too got the CPO on Sep 7, 2010. But we did not get any email about dependent application. After seeing this post, I just called the customer service and spoke with level 2 officer. According to him my application is still pending even though the online status and email shows approved. I am really concerned that still there is no approval. Moreover, I can not even open a SR because my status shows CPO. please advise me what to do.

I too moved out of city (Austin to Dallas) and changed employers. I have informed about the change of address and it has been successfully updated and there is no RFE.

+1. Not sure why people hesitate to send in documentation when they switch jobs under AC21 provisions.
But its been suggested that Ac21 should be filed with new pay stubs from employer along with supporting documentation etc.

Exactly, this is what I had already said in another thread. And Ted Kennedy mentioned on C-SPAN2 during CIR discussions that he thinks legal immigrants do not need as much sympathy as the illegals (that we do not suffer the same conditions as illegals).
I cannot think of one Democrat who I feel is an 'ally' to us. So as much as I hate to say this, I don't think a Democrat controlled House or Senate helps us. Damn, I don't like Republicans foreign policy either... this sucks.
Well, the Democrats wont have the guts to reject a border security only bill this close to the elections. You have a misguided sense of belief in the democrats. Only the republicans will deliver on the skills immigration front not the union backed democrats. They are only after the latino votes and it was clear from the hearings of the judicial committee that CA senators such as Diane Fienstein was almost hostile towards skilled immigration while sneaking in special green card quotas for farmworkers.

how abt passport copies , can we staple them as there wud be many pages and can create confusion to the mailroom clerk
you can staple passport copies . In my case I have 3 passport booklets and so had to put a clip binder to hold them.
